US Court Mandates Freedom of Abrego Garcia from ICE Detention
A court has ordered the prompt release of Kilmar Abrego Garcia from detention by ICE, concluding his continued detainment is without lawful basis.
"Since Abrego Garcia's return from wrongful imprisonment in El Salvador, he has been taken back into custody, again without lawful authority," Judge Paula Xinis stated in her order.
The case stems from a mistaken removal to El Salvador in March, which the government later admitted was an mistake. After his repatriation to the United States to face alien smuggling allegations, he was held in federal detention.
In her order, the court pointed out that the authorities does not have a valid removal order, which effectively blocks them from deporting Mr. Abrego Garcia "at this juncture."
